being duly sworn says: I reside in St. Joseph Berrien County Michigan and have resided here for 21 years. I am a physician and surgeon and have been in the active practice of my profession in St. Joseph and vicinity ever since I came here. I was Asst. Surgeon of 12 th Mic. Vol. Inf. I knew a man who lived near St. Joseph by the name of “Rofe”. I remember that he was commonly called “Doc”. He was a chicken & egg buyer part of the time, traveling around the country, and speculating in funs some. If he ever attended a patient as a physician it must have been on account of the patients ignorance, as this man Rofe was never recognized or accepted as a physician by the profession in this vicinity. I never knew that he claimed to be a physician until recently. I do not know where he is now. He was only a short time in this vicinity. In my judgement it would be a travesty on the profession to accept his affidavit as last attending physician in a pension claim or any other case. On this Second day of January A. D. one thousand eight hundred and

sixty Seven personally appeared before me, theClerk of theCircuit Court within and for the County and State aforesaid, Nelson Upson aged 25

years, a resident of St Joseph in the State of Michigan

who being duly sworn according to law, declares he is the identical Nelson Upson

who enlisted in the service of the United States as a Private in the Company (K)

commanded by Lieut Geo P Robertson in the Eleventh Regiment of

Missouri Infantry commanded by Col. Bovier

in the War of the Rebellion in the Southern States, and was honorably discharged on the

Fifteenth day of January in the year 1866; that, while in the service afore-

said, and in the line of duty, he became disabled at the time and place, and in the manner following, to wit: At the Battle of Nashville on the Sixteenth day of December 1864 while in said company while on a charge he was wounded in the right arm breaking the bone below the elbow. Since which time the arm has never been well. That the bones slipped past and never re united. That after his wound he was taken to Hospital Thru Branch One and after that remained in different hospitals for about a year and joined his Company at Memphis Tennesee and was there discharged.

The said Nelson Upson makes Declaration for the

purpose of obtaining the benefit of Invalid Pension Laws of the United States; and doth hereby constitute and appoint George S. Calpp of St. Joseph his true and lawful Attorney with full power of substitution, authorizing him to prosecute this, his Claim for a Pension, and to receive and receipt for any Duty or Certificate which may be issued thereon, and to do all other acts which may be necessary in the premises.

Also, personally appeared Charles Williams and Adrian Cortiville residents of Berrien County persons whom I certify to be respectable and entitled to credit and who, being by me duly sworn according to law, say that they were present and saw Nelson Upson sign and make oath to the foregoing Declaration and Power of Attorney; and they further swear that they have very reason to believe, from the appearance of the applicant and their acquaintance with him, that he is the identified person he represents himself to be, and that they (deponents) do reside in the County of Berrien aforesaid, and are disinterested in this claim. And deponents further state, that the said Nelson Upson is by occupation a Farmer and that his habits of life are now and have been since his discharge, uniformly good. That the said “Upson” interlined in the second line of this page was so interlined before we signed.

Thomas S. Hawley being duly sworn on oath says that he is a physician and surgeon residing and practicing in the city of St Louis Mo: that during the late war he was duly commissioned first as Asst. then as surgeon with the rank of Major of the 11 th Mo Infantry … Vols and served as such from June 17, 1863 to January 16, 1866.

That he knew of his personal knowledge that private Nelson Upson of “K” Co. 11 th Mo Inf … Vols which engaged in battle with the enemy at or near Nashville Tennessee on the 16 th day of December 1864 was severly wounded with a Minnie ball passing through his right arm producing a severe and complicated wound immediately after receiving this injury he with all the other wounded was removed to the General Hospital in Nashville, Tenn. He was incapacitated from further Military duty and in the opinion of affiant is at least one half disabled from obtaing his subsitance by manual labor.

I, John Murphy a resident of Saint Joseph in the County of Berrien and State of Michigan, aged 52 years on oath deposes and says in relation to the pension claim of Elizabeth Upson widow of the late Nelson Upson late of Co. I, 7 th Reg’t, Missouri Vols., as follows: that this affiant knew the said Nelson Upson before the war of the rebellion, that at that time he appeared to be a sound able bodied man, that on his return from the army at the close of the war, he looked and appeared in poor health, and I considered him in poor health but could not say just what his disease was, and he was never a well man or in good health after I knew him until his death in 1876. He had told this affiant he ws in poor health, that he has been acquainted with Elizabeth wife of said Nelson Upson since their marriage and that he has resided in St Jospeh most nearly all the time from his return from the army until his death, and that –said Elizabeth has not remarried, had she done so I would have know it, and the children Elanor, Carrie, Nelson and Willie are still living.

I further state I have no pecuniary interest in this claim, and that my post office address in Saint Joseph Michigan

I knew Nelson Upson when he was a boy, knew him when he went -into- the army, considered him a well man when he went into the army-I lived neighbor to him then. When he returned from the army he was in poor health then I saw him carry sand at a church building and he appeared to be unable to work I have known the family until this day. Nelson Upson died in about 1876-his wife Elizabeth has not remarried since the death of her husband, and has not abandoned her children form in all, viz: Nora, Carrie, Nelson and Willie who are now living with their mother in St. Joseph. I knew Elizabeth to work hard washing and other work to keep her children together, and keep them at home and cared for them faithfully. Her Post Office address is Saint Joseph Michigan

I further declare that I no interest in said case and I am not concerned in its prosecution.

I knew the late Nelson Upson before he enlisted in the army and knew him when he came home from the army. He was well & able bodied before he enlisted and when he came home he showed me where he was wounded and I worked with him, and he complained a good of his arm paining him, and some of the time he was unable to work at all from the effects of said wound and was never able to do a full days work when working with me, He seemed to be broken down in general health after he came back from the army and never seemed to be the same man he was before he enlisted and I further believe that his health and his constitution was … and broken down from the hardships and exposures incurred while in the army

I further declare, that I have no interest in said case, and am not concerned in its prosecution, and am not related to the applicant.

I hereby certify that I knew the above Nelson Upson from the later part of the year 1872 up to the time of his death and that he worked for me off and on as his health would admit for several years that I am well aquainted with his widow Mrs Elizabeth Upson as she has worked in my family a great deal washing & co and believe her to be a worthy person in every respect. That the said Nelson Upson was suffering from a gun shot wound in the arm which he said he received while serving in the American Army during the late rebellion. That he was troubled with a bad cough which he said originated from a bad cold which he caught while in said Service from which he had never recovered from and subsequently caused his death. That the above said Elizabeth Upson has never to my knowledge remarried to my knowledge that she has been diigant in working for the support of her family to the best of her ability.

I William G. Ensley a resident of St Joseph in the county of Berrien and State of Michigan, aged 62 years on oath depose and say in relation to the pension claim of Nelson Upson late of Co. I 7^th Reg’t, Mo Inft. Vols., as follows: I first knew said Nelson Upson in the year 1865. I knew him intimately from 1866 to the time of his death in the year 1876. He died in the township of Lincoln near this village-I knew him to have been troubled with lung disease for he often stopped at my house; first in 1866 and at that time he would cough and spit up phlegm and blood and could do no work on account of said trouble. Afterwards I saw him try to split some wood and he could not on account of his cough and in fact it troubled him in all these years and in capacitated him from labor.

I further state that I have no pecuniary interest in this claim, and that my post office address is Saint Joseph Michigan

The first became accunated with Nelson Upson on or about the close of the war on his return home he resided with his mother until he married a few months after the said Elizabeth. They then took up a residence opposite his house in St Joseph. He resided in St Joseph and vicinity until his death in the yaer 1876. That he worked for this affiant at different times for about three years after his return from the army. He had a serious cough and appeared to have the lung trouble so much so that although his work was light when he worked for the affiant-being working in a nursery-often obliged to stop work and often confined to his house several days at a time because of this lung trouble and that he deffered from work on account of his disability-about one-half his time and that he continued in poor health until his death on account of the cough and lung trouble

I further declare I have no interest in said case and am not concerned in its prosecution.

I knew Nelson Upson Before he went into the army and knew him Since his return from the army. I know that he had a Bad wrist-the right one he said he was Shot through the wrist at the Battle of Nashville Tennessee I know that his wrist was Lame continuously and he could not Do manual Labor on account of Said Lameness I knew him up to the time of his death he died here in St Joseph Michigan from lung trouble which he Said he contracted while in the army Just Previous to the Battle of Nashville, Tennessee
